Apparently the crux of the homeowner association’s position hinges on its bylaw that requires anyone building a home in the city to “proceed diligently.” The word proceed means “to go forward,” and the word diligent means “painstaking, with careful attention to detail.” There is no link between the phrase “proceed diligently” and time.
The Aughinbaughs could theoretically continue building for another 30 years and still be said to be proceeding diligently.
