Father in Surrogate Mother Case Petitions Court to Get Full Custody of Daughter

SANTA ANA — Robert P. Moschetta, who is in a legal battle with the surrogate mother of his daughter, has petitioned the 4th District Court of Appeal for a court order giving him full, rather than joint legal and physical, custody of Marissa Moschetta.
On Sept. 26, an Orange County Superior Court judge granted both legal and physical custody of Marissa to her birth mother, Elvira Jordan, and Moschetta.
The appeals court is being asked to go along with a counseling center’s recommendation to grant custody to Moschetta and only visitation rights to Jordan, a plan rejected by the lower court.
